Terms of Use
These terms govern your use of Kavchat, a scripted customer-support chat service for websites and apps. Please read them before you create a workspace. By creating an account or using the service you agree to these terms on behalf of yourself and the business you represent.
1. Who we are
Kavchat ("Kavchat", "we", "us") is operated by maxsave. You can reach us at support@kavchat.com.
2. Definitions
- Service: the Kavchat dashboard at app.kavchat.com, the website widget, the mobile and server SDKs, the API and related support.
- Workspace: the account in which a business builds scripts, invites team members and receives requests. Plans and limits apply per workspace.
- Customer or you: the business or person that opens a workspace.
- End users: the people who chat with your bot on your website or in your app.
- Your content: scripts, answers, keywords, settings and any data you or your end users submit through the Service.
3. Your account
You must be at least 18 years old and authorized to act for the business you register. Keep your login details confidential and give access only to team members you trust. You are responsible for what happens in your workspace, including actions taken by your team members. Tell us promptly if you suspect unauthorized access.
4. Plans and limits
The current plans, limits and prices are described on the pricing page. A conversation is one chat session with an end user. When a Free workspace reaches its monthly conversation limit, the widget is hidden until the next month starts or until you upgrade.
The Kavchat badge appears in the widget. On the Free plan, you must not hide, remove, or modify it. On Premium, you can hide it in the bot settings.
We may change plans, features or prices. If a change affects a paid plan you already have, we will tell you by email before it takes effect, and the new price will apply only from your next renewal. You may cancel before then.
5. Payment and renewal
- Premium is billed in advance, monthly or yearly, in US dollars, and renews automatically at the end of each period until you cancel.
- Card payments are processed by a licensed, PCI DSS certified payment processor. We never see or store your full card number.
- Prices may be subject to taxes required by law. A tax invoice is sent to you by email after each payment.
- If a renewal payment fails, we may try again and, if it still fails, move your workspace to the Free plan.
6. Cancellation and refunds
You may cancel at any time. Cancellation stops future renewals. Refunds are handled under our cancellation and refund policy, which forms part of these terms.
7. Acceptable use
You agree not to use the Service, and not to let others use it, to:
- send spam or unsolicited bulk messages;
- publish or collect content that is illegal, infringing, defamatory, hateful, sexually exploitative or harmful to minors;
- impersonate any person, business or authority, or mislead end users about who they are talking to;
- collect passwords, full payment card numbers or other sensitive data through scripts or the contact form, unless you are lawfully allowed to and protect it properly;
- distribute malware, probe or break the security of the Service, or place an unreasonable load on it;
- resell or sublicense the Service without our written permission, or copy it to build a competing product.
We may suspend a workspace or remove content that breaks this section or the law. Where reasonable, we will tell you first and give you a chance to fix the problem.
8. Your content
You keep all rights in your content. You give us a limited permission to host, copy, process and display it only as needed to run, secure and improve the Service for you. The bot shows your end users the answers you write, so you are responsible for their accuracy and for having the rights and consents your content requires.
9. Data processing
For the personal data of your end users that passes through the Service, you are the controller and we are the processor. This means:
- we process that data only to provide the Service and according to your instructions, which these terms and your settings in the dashboard record;
- you are responsible for having a lawful basis for the processing and for informing your end users, for example in your own privacy policy;
- our staff and service providers who access the data are bound by confidentiality;
- we use the service providers listed in our privacy policy and will update that list before adding a new one that processes end-user data;
- we apply reasonable technical and organizational security measures and will notify you without undue delay of a security breach affecting your end users' data;
- we will help you, as far as reasonable, to answer end users who exercise their privacy rights;
- when your workspace is deleted, we delete its end-user data within a reasonable period, unless the law requires us to keep it.
Retention periods for end-user data are described in the privacy policy.
10. The Service
We work to keep the Service available and reliable, but we do not promise that it will be uninterrupted or error-free. We may change, add or remove features. Some parts, such as guides for certain SDKs, may still be in preparation.
The Kavchat software, name, logo and website belong to the operator. These terms do not give you any rights in them except the right to use the Service as described here. If you send us suggestions, we may use them without obligation to you.
11. Disclaimer and limitation of liability
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties, such as fitness for a particular purpose.
To the extent the law allows, we are not liable for indirect or consequential damages, lost profits, lost revenue or lost data, and our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived.
12. Indemnity
You will compensate us for reasonable costs, including legal fees, arising from a third-party claim caused by your content or by your use of the Service in breach of these terms or the law.
13. Ending the agreement
You may stop using the Service and delete your workspace at any time. We may suspend or close a workspace that seriously or repeatedly breaches these terms, or if the law requires it. Sections that by their nature should continue, such as payment obligations, liability and governing law, continue after the agreement ends.
14. Changes to these terms
We may update these terms. We will post the new version on this page with a new date and, for significant changes, tell you by email in advance. If you continue to use the Service after the change takes effect, the new terms apply.
15. Governing law and courts
These terms are governed by the laws of the State of Israel. The competent courts in the Northern District of Israel have exclusive jurisdiction over any dispute related to them or to the Service, unless mandatory law gives you the right to bring a claim elsewhere.
